1. Definitions
-
1.1. In these Terms and Conditions:
-
"Credit(s)" means the credit point(s) electronically credited onto the munch Card under this Program;
-
"munch Card" means the munch loyalty swipe card issued to consumers to track their purchase of Qualifying munch Products and Credits under the Program;
-
"Participating 7-Eleven Store" means any 7-Eleven store which has agreed to offer the Program to consumers and displays the "munch Money" Point of Sale Material to identify it as a participating 7-Eleven store;

"Point of Sale Material" means the in-store display material, but excludes product packaging;

"Program" means this '7-Eleven munch' loyalty program;

"Promoter" means 7-Eleven Pty Ltd (A.B.N. 48 005 299 427) of 357 Ferntree Gully Road, Mount Waverley, Victoria, 3149;

"Qualifying munch Product" means any munch branded products carrying the "munch Money" logo, and between the dates of 1 September – 31 November 2008 any munch branded hot pastries.

1.2. As a condition of participation in the Program, the consumer agrees to be bound by these terms and conditions and any rules that may be adopted by the Promoter from time to time.

1.3. The Promoter and/or the Participating 7-Eleven Store's decision on all matters pertaining to the Program are final and binding. No correspondence will be entered into.

1.5. This Loyalty Program is not valid in conjunction with any other offer unless otherwise expressly specified by the Promoter.

2. Munch Card

2.1. To receive a munch Card, the consumer must purchase a Qualifying munch Product from a Participating 7-Eleven stores and request a munch Card at the time of purchase.

2.2 The Promoter takes no responsibility for any munch Card which has been lost or stolen.

3. Credits
-
3.1. Consumers will receive 1 x Credit for every Qualifying munch Product purchased at a Participating 7-Eleven Store when they present their munch Card at the time their Qualifying munch Product is purchased.

3.2 Credits cannot be transferred to another munch Card and cannot be exchanged for cash. Subject to clause 3.3 Credits are valid for one year unless the Program is terminated earlier.

3.3. In the event that the Program is terminated, the Promoter in its absolute discretion may choose to honour any unredeemed Credits for a six (6) month period from the date of termination of the Program.

4. To redeem under the Program

4.1 When a consumer has accrued 4 x Credits on their munch Card, the Participant will be eligible to redeem 1 x Qualifying munch Product from a Participating 7-Eleven Store, and if the consumer is redeeming in a Participating 7-Eleven Store in New South Wales, he/she will also be able to redeem 1 x 600ml Coca-Cola variety (Coca-Cola varieties include Coca-Cola, Diet Coke and Coke Zero only).

4.2 To redeem, consumers must present their chosen product(s) (pursuant to clause 4.1) at the counter along with their munch Card. The counter staff will swipe the munch Card which will deduct 4 x Credits from their munch Card.

5. Promoters' rights

5.1. If for any reason this Program is not capable of running as planned as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this Program, the Promoter reserves the right in its sole discretion to disqualify any consumer who tampers with the system, and to cancel, terminate, modify or suspend the Program.

5.2 The Promoter may, in its absolute discretion:
- (a) change, amend or vary these terms and conditions; or
- (b) cancel or terminate the Program in whole or in part in its absolute discretion; or
- (c) vary or add to the list of Qualifying munch Products;
- (d) exclude a consumer from participating in the Program or cancel a consumer's munch Card.
Any amended terms and conditions will be displayed in Participating 7-Eleven Stores and will take effect immediately. If a munch Card has been terminated, the consumer will not be entitled to redeem any unused Credit(s).

5.3. Except for any liability that cannot be excluded by law, the Promoter and Participating 7-Eleven Stores (including its officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Program, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's or the Participating 7-Eleven Store's control); (b) any theft, unauthorised access or third party interference; (c) any munch Card which is lost or stolen; (d) for participating in the Program; (e) any variation of the Terms and Conditions and/or cancellation of the Program.
